Vaccaya Terms and Conditions

These Terms and Conditions (the "Terms") govern the legally binding relationship between you and us when you use our Website and/or Mobile App and the Services that we provide.


In these Terms, references to "us", "we", "our", or "Vaccaya" shall mean Vaccaya by Vaccaya LLC, 8 The Green, Suite A, Dover, DE 19901,

USA. When we refer to "you", we mean any person or entity that accesses or uses the Services.


Bookings made through our Website, Mobile Application, or via our employees or authorised representatives through telephone, email, instant messaging applications, or any other form of communication shall be subject to these Terms. A person making the Booking on behalf of other person(s) shall be taken to have the authority to agree to these Terms on behalf of any other person(s).


BY USING OR ACCESSING THE WEBSITE, MOBILE APP, OR SERVICES, YOU ACKNOWLEDGE THAT YOU UNDERSTAND AND AGREE TO BE LEGALLY BOUND BY THESE TERMS.


1. Definitions

In these Terms:

1.1 Headings are for reference purposes only and shall not aid in the interpretation of the clauses to which they relate.

1.2 Unless the context clearly indicates otherwise, the use of any gender includes the other genders, the singular includes the plural and vice versa, and natural persons include legal entities and vice versa.

1.3 The following terms shall have the meanings assigned to them hereunder, namely:


Accommodation Provider: means the provider or supplier of a hotel, hostel, serviced apartment, bed-and-breakfasts, rooms for rent, or other place of accommodation or lodging, including but not limited to accommodation operators such as hospitality groups;


Activity Provider: means the provider or supplier of any tours, activities, and/or experiences, including but not limited to activity booking facilitators or services;


Additional Services: means any service related to your Booking provided by a Service Provider, including (without limitation) upgrades, incidental charges, additional luggage, priority seating, meals, mini-bar, dry cleaning and laundry, passenger information changes, rebooking, or cancellation. These services are determined by the Service Provider(s) and are not included in the Total Price, unless you add these services to your Booking during the Booking process;


Booking: means the process of purchasing a selected hotel, flight, or activity (including any multiple or combination of these) and the resulting outcome of this process. A Booking is completed when we confirm that we have received and accepted your payment amounting to the Total Price;


Booking Confirmation: means any physical or digital document that is intended to confirm a Travel Product that has been arranged with a Service Provider based on your choices or instructions. These documents may include, but are not limited to, hotel vouchers, airline itineraries/e-tickets, and activity tickets;


Cancellation Fees: means any fees charged by us and/or the Service Provider in the event of cancellation of a Booking or any part of a Booking, including voluntary cancellations initiated by you or cancellations initiated by the Service Provider;


Change Fees: means any fees charged by us and/or the Service Provider in the event of changes to a Booking or any part of a Booking;


Mobile App: means the Vaccaya mobile application that enables you to use or access the Services;


Service Provider: means the Carrier, Accommodation Provider, Activity Provider, or any other third party responsible for delivering the goods and/or service(s) purchased as part of a Booking;


Services: means the Booking facilitation services provided by us on the Website, Mobile App, and/or via manual operations in accordance with these Terms;


Total Price: means the final price displayed immediately prior to the purchase or payment of each Booking;


Travel Product: means the products provided by Service Providers that we offer on our Website and/or Mobile App;


Vaccaya Account:  means the registered account you use to log in to the Website and/or Mobile App;


Vaccaya Wallet: means the digital asset or cryptocurrency wallet associated with your Vaccaya Account used to store your deposited funds or funds otherwise acquired by you;


Website: means the website and platform located at Vaccaya.com and all associated domains or subdomains at this URL.


2. Services and Platform Usage

2.1 Service Provision

Our services comprise the following core elements that we provide to you in exchange for the Total Price:

(i) Display and maintenance of comprehensive Travel Product information and pricing on our Website and Mobile App;

(ii) Provision of secure and functional booking platforms through our Website and Mobile App that enable you to select and purchase Travel Products;

(iii) Facilitation of contractual relationships between you and relevant Service Providers;

(iv) Processing of payments, including both traditional and cryptocurrency transactions;

(v) Delivery of Booking Confirmations and related travel documentation;

(vi) Customer support services related to your bookings and platform usage.


2.2 Booking Agreement

When you complete a Booking through our Website or Mobile App, you enter into a binding agreement subject to these Terms. This agreement is formed when we confirm receipt of your payment. For bookings made through other channels (such as telephone or email), these Terms apply based on your explicit offer to purchase after we have provided all relevant booking information.


2.3 User Representations

By making a Booking, you represent and warrant that:

(i) You are at least 18 years of age (or the legal minimum age in your jurisdiction if higher);

(ii) You have the legal capacity to enter into binding contracts;

(iii) You understand and accept these Terms;

(iv) You have reviewed and accept any relevant Service Provider terms and conditions;

(v) All information you provide is accurate and complete.


3. Vaccaya Account

3.1 Account Creation and Management

To use our Services, you must create a Vaccaya Account by providing accurate and complete registration information. You acknowledge that your account credentials and authentication methods are personal to you and represent your digital identity on our platform. The security of your account credentials, including your password and any additional authentication factors, is your sole responsibility. Any disclosure of your credentials to third parties, whether intentional or not, may compromise our security measures and lead to unauthorized access to your Vaccaya Account, for which we bear no liability.


3.2 Account Security Obligations

You assume full responsibility for maintaining the security of your Vaccaya Account credentials and any associated authentication methods. This includes selecting strong passwords, enabling additional security features when available, and monitoring your account for suspicious activity. You agree to notify us immediately at contact@Vaccaya.com if you detect any unauthorized access or suspicious activity related to your account. You acknowledge that you are solely responsible for all actions conducted through your Vaccaya Account, whether authorized by you or not.


3.3 Account Restrictions and Termination

We reserve the right to suspend, terminate, or restrict access to the Website, Mobile App, your Vaccaya Account, or any part of our Services at our sole discretion, without prior notice or liability. Such actions may result in temporary or permanent inability to access your account or use our Services. You may choose to terminate your Vaccaya Account at any time by contacting us, which will result in the discontinuation of all Services associated with your account.


4. Travel Requirements and Documentation

4.1 Travel Documentation Responsibility

While our staff may provide general information about travel documentation requirements, you acknowledge that obtaining and maintaining valid travel documents is your sole responsibility. This includes:

(i) Valid passports for all travelers, including any specific validity requirements (such as six months beyond return date); (ii) Appropriate visas and permits for all destinations and transit points; (iii) Health documentation and vaccination records as required by various jurisdictions; (iv) Any other documentation required for international travel.


Any penalties, fines, or additional expenses incurred due to inadequate or missing documentation are your sole responsibility.


4.2 Passport Requirements

Every person included in a Booking must possess a valid passport that meets all destination requirements. Many countries require passports to be machine-readable and valid for a minimum period beyond your intended stay. You must ensure all travelers have the necessary documentation for both destination and transit countries. If any traveler lacks proper documentation, you must contact us immediately at contact@Vaccaya.com.


4.3 Special Requirements and Requests

If you have specific requirements such as dietary restrictions, accessibility needs, seating preferences, or other special requests, you must:

(i) Indicate these during the booking process; (ii) Contact us immediately after booking completion if not previously specified; (iii) Understand that while we will make reasonable efforts to accommodate such requests, we cannot guarantee their fulfillment by Service Providers; (iv) Accept that special requests may incur additional charges.


5. Booking Confirmations and Documentation

5.1 Delivery and Verification

Upon successful payment and booking completion, we will deliver Booking Confirmations electronically to your registered email address. You must:

(i) Ensure your provided email address is correct; (ii) Review all details in the Booking Confirmation immediately upon receipt; (iii) Contact us promptly if you do not receive your confirmation or notice any discrepancies; (iv) Maintain copies of all travel documentation throughout your journey.


5.2 Document Requirements and Restrictions

Booking Confirmations and associated travel documents:

(i) Are non-transferable and must match the traveler's identification exactly; (ii) Must be presented in either electronic or printed format as required by Service Providers; (iii) May be subject to specific conditions or restrictions imposed by Service Providers; (iv) Must be retained and available for presentation throughout your journey.


For flight bookings, you must ensure all names exactly match passport details, including middle names. Any discrepancies may result in denied boarding or additional fees for corrections.


6. Payment and Pricing

6.1 Payment Processing

We accept various payment methods, including:

(i) Multiple cryptocurrencies and digital assets; (ii) Traditional payment methods such as credit cards and bank transfers; (iii) Other payment systems as specified on our platform.


All payments must be made in full before a Booking is confirmed. We reserve the right to partner with third-party payment processors for secure transaction handling.


6.2 Cryptocurrency Payments

When making payments using cryptocurrencies:

(i) You acknowledge that cryptocurrency values are subject to market volatility;

(ii) Transaction completion is based on blockchain confirmation times;

(iii) You must ensure accurate wallet addresses and payment amounts;

(iv) Refunds may be subject to special conditions due to cryptocurrency price fluctuations;

(v) You bear responsibility for any transaction fees or gas costs.


6.3 Pricing and Currency

All prices displayed on our platform:

(i) Are shown in your selected currency but may be processed in other currencies;

(ii) Include applicable taxes and basic service fees;

(iii) May fluctuate based on availability and demand;

(iv) Are only guaranteed once payment is completed and confirmed.


7. Cancellations and Modifications

7.1 Cancellation Policy

All cancellations are subject to the following conditions:

The applicable cancellation policy will be displayed during the booking process and referenced in your Booking Confirmation. Cancellation policies vary by Service Provider and Travel Product type. You acknowledge that:

(i) Some bookings may be non-refundable;

(ii) Cancellation fees may apply based on the timing of cancellation;

(iii) Multiple Service Providers may each apply their own cancellation fees;

(iv) Administrative fees may be charged by Vaccaya in addition to Provider fees;

(v) Cryptocurrency refunds are subject to our digital asset refund policy.


7.2 Modification Terms

Booking modifications may be requested up to 72 hours before the scheduled service date, subject to:

(i) Service Provider availability and policies;

(ii) Payment of any applicable Change Fees;

(iii) Price differences between original and modified bookings;

(iv) Administrative fees for processing changes;

(v) Technical feasibility of requested changes.


7.3 Refund Processing

When a refund is approved:

(i) Processing times vary by payment method and Service Provider;

(ii) Cryptocurrency refunds may be issued in travel credits due to value volatility;

(iii) Traditional payment refunds will be processed to the original payment method;

(iv) Administrative fees are generally non-refundable;

(v) Partial refunds may be provided for partially used services.


8. Intellectual Property and Platform Usage

8.1 Ownership and Rights

All content on our Website and Mobile App, including but not limited to:

(i) Text, graphics, logos, and images;

(ii) Software, algorithms, and code;

(iii) Database structures and compilations;

(iv) Interface designs and layout;

(v) Trademarks and service marks;

is owned by or licensed to Vaccaya and protected by intellectual property laws.


8.2 Permitted Usage

We grant you a limited, non-transferable license to:

(i) Access and view our platform content for personal use;

(ii) Make legitimate bookings through our services;

(iii) Use platform features as intended;

(iv) Store and print necessary travel documentation.


8.3 Prohibited Activities

You are strictly prohibited from:

(i) Scraping, mining, or extracting platform data;

(ii) Reproducing or distributing platform content;

(iii) Modifying or creating derivative works;

(iv) Attempting to decode or reverse engineer any part of our systems;

(v) Using our platform for commercial purposes without written authorization.


9. Privacy and Data Protection

9.1 Data Collection and Usage

We collect and process personal data in accordance with our Privacy Policy, including:

(i) Information provided during account creation;

(ii) Booking and transaction details;

(iii) Communication records and preferences;

(iv) Usage data and analytics;

(v) Cryptocurrency wallet addresses and transaction histories.


9.2 Data Security

We implement comprehensive security measures including:

(i) Encryption of sensitive data;

(ii) Secure socket layer (SSL) technology;

(iii) Access controls and authentication systems;

(iv) Regular security audits and updates;

(v) Compliance with applicable data protection regulations.


10. Service Provider Relationships

10.1 Role as Intermediary

Vaccaya acts as an intermediary platform:

(i) Facilitating connections between users and Service Providers;

(ii) Processing payments and confirmations;

(iii) Providing booking management tools;

(iv) Maintaining communication channels;

(v) Supporting customer service needs.


10.2 Service Provider Obligations

Service Providers are solely responsible for:

(i) Delivery of booked services;

(ii) Quality and standards of service;

(iii) Handling of customer service issues;

(iv) Compliance with local regulations;

(v) Management of schedule changes or cancellations.


11. Limitation of Liability

11.1 Scope of Liability

Vaccaya' liability is limited to:

(i) The actual booking facilitation services we provide;

(ii) The proper functioning of our platform;

(iii) Accurate representation of information provided to us;

(iv) Secure processing of payments;

(v) Protection of user data within our control.


11.2 Liability Exclusions

We are not liable for:

(i) Service Provider performance or failures;

(ii) Force majeure events affecting travel services;

(iii) User errors in booking or payment processes;

(iv) Cryptocurrency market fluctuations;

(v) Third-party payment processor issues.


12. Dispute Resolution

12.1 Resolution Process

All disputes shall be resolved through:

(i) Initial communication with our customer service team;

(ii) Formal complaint submission if necessary;

(iii) Mediation attempts where appropriate;

(iv) Binding arbitration as a last resort;

(v) Legal proceedings under United States jurisdiction.


12.2 Arbitration Agreement

Any unresolved disputes shall be:

(i) Submitted to arbitration in United States;

(ii) Conducted in the English language;

(iii) Decided by a single arbitrator;

(iv) Binding on all parties;

(v) Subject to United States law.


13. Amendments and Updates

13.1 Terms Modifications

We reserve the right to:

(i) Update these Terms at any time;

(ii) Modify our Services and features;

(iii) Change pricing and payment methods;

(iv) Adjust booking policies and procedures;

(v) Revise platform functionality.


13.2 Notice and Effect

Changes to Terms will be:

(i) Posted on our Website and Mobile App;

(ii) Effective immediately upon posting;

(iii) Binding upon continued platform use;

(iv) Notified to users when significant;

(v) Applicable to all existing and future bookings.


14. General Provisions

14.1 Severability

If any provision of these Terms is found invalid:

(i) The remaining provisions remain in full effect;

(ii) Invalid provisions will be modified to be enforceable;

(iii) Unenforceable provisions will be replaced;

(iv) The overall intent of the Terms will be preserved;

(v) Legal obligations will continue to be binding.


14.2 Governing Law

These Terms are governed by:

(i) The laws of United States;

(ii) Applicable international travel regulations;

(iii) Relevant cryptocurrency regulations;

(iv) Data protection laws;

(v) Consumer protection statutes.
